General Business Terms
Art. 1. General Provisions
1. These General Terms and Conditions /hereinafter referred to as "GTCs"/ set out the legal relationships entered into by Slovenské liečebné kúpele Turčianske Teplice, a.s. (Slovak Medical Spa Turcianske Teplice, a.s.) and its clients /hereinafter referred to as "Contracting Parties"/ within the framework of services provided by Slovenské liečebné kúpele Turčianske Teplice, a.s. /hereinafter referred to as "SLK TT"/, whereas the GTCs constitute a fundamental legal regulation applicable for these relationships. In some cases of individual relationships formed between SLK TT and its clients, it is possible to depart from these GTCs and resolve selected aspects of these legal relationships on a separate basis. Regulation of individual cases may arise from a contract between SLK TT and its client, from other agreement between the Contracting Parties as well as from a unilateral declaration of SLK TT. The rule is that individual regulation agreed on by Contracting Parties to provide for their legal relationships and which differs from the GTCs prevails over these GTCs.
2. The GTCs regulate the conditions of the provision of complex spa services including accommodation and catering, outpatient services, individual procedures and supplementary services.
Art. 2. Formation of Contractual Relationship
1. As a rule, the contractual – legal relationship between Contracting Parties is formed on the basis of:
- agreement or another type of bilateral legal act between the Parties
- order placed by a client in written form, by telephone, fax or e-mail which has been confirmed by SLK TT
- payment for the provision of services
- application of a Gift Voucher issued by SLK TT on the condition that SLK TT has approved or confirmed the possibility to use the services on a given date
2. Client´s order shall include in particular:
- clear denomination proving that the document is an order
- name and address of the client
- check-in and check-out date of accommodation /procedure/, number of clients and their names
- required type of stay /procedure/, required hotel services
- requirements for accommodation /spa house, category, type of room
- requirements for catering, transfer and other supplementary services
- signature of the client, place and date of issue
Art. 3. Payments
- After confirmation of order of stay by the spa facility or confirmation of order of free procedures, the client is obliged to pay a deposit amounting to 100% of the price of stay to the bank account of the spa facility at the latest 21 days before check-in or at the latest 21 days before the start of the first procedure. In case of reservation and confirmation of order of stay within a period shorter than 21 days before check-in, the client is obliged to pay the price of the stay by return and send the payment confirmation by fax, e-mail or mail to the address of the spa facility. In case the deposit has not been paid in accordance with the said conditions, the order of stay or procedure shall be cancelled.
- SLK TT as a service provider issues Gift Vouchers for its clients which enable them to use different services. Clients can buy Gift Vouchers at SLK TT selling points or order the vouchers to be delivered by the sales department of SLK TT. The validity of a Gift Voucher is indicated on its front side. Clients may only use individual services through a Gift Voucher until the date of expiry indicated on the voucher. In case the client did not use the services while the voucher was valid, he/she can no longer use the service with no right to claim any compensation. The service selected from SLK TT offer and indicated on the Gift Voucher shall be delivered to the client – the person who has presented the Gift Voucher. Clients are obliged to reserve the date of use of a given service by telephone on a phone number 043 / 4913 111 or by sending an e-mail to the given contact e-mail addresses. After the confirmation of reservation by SLK TT, it becomes binding and the date of delivery of service can be changed for serious reasons only , whereas a new date must be agreed 3 days before the reserved date at the latest.
- Clients may carry out payments by bank transfer or by credit card after previous authorisation within given periods. Bank fees associated with the realisation of payment shall be paid by the client.
- The spa facility gives great importance to the protection of personal data of its clients. Therefore it is bound to ensure the protection of personal data published in the reservation form, prevent their illegal collection and other forms of abuse by strengthened technical and organisational security measures. The processing of data complies with strict legal regulations providing for personal data protection.
- At the same time, by ordering services on-line the clients declare that they agree to the processing and storing of their personal data in registration documents for the purposes of conclusion, fulfilment and enforcement of contractual obligations and for registration purposes.
- The purchasing price is considered to be paid when the total sum has been credited to the bank account of the spa facility in a bank indicated in the contract, invoice or order confirmation. Failure to pay in accordance with agreed conditions is considered to be a serious breach of contract or agreement.
- In case of a material breach of contract by the client or in case of failure to pay the purchase price or failure to pay within periods given by the contract, invoice or order confirmation, the spa facility has the right to withdraw from the contract or cancel the order. In such cases the spa facility is entitled to claim damages.
- The Spa Fee forms an inseparable part of the price of the stay and it relates to one night per person. The spa facility reserves the right to offer a reduction on the fee in selected legitimate cases. The Spa Fee does not replace the municipal accommodation tax.
Art. 4. Ordering, Accommodation and Services
1. Clients can reserve a stay in person, by phone, e-mail, fax and mail. After paid total sum of the stay, the spa facility shall send to the client an accommodation voucher and instructions to the address given in an e-mail or a fax message, letter or telephone reservation. In case of reservation of free procedures, the client shall be sent a spa voucher and a timetable of procedures after payment or on the first day after check-in for free procedures.
Art. 5 Length of stay, arrival and departure
1. For treatment purpose we recommend client´s stay at least 21 days. This length is in accordance with long term medically approved research and experience. For clients from health insurance is number of treatment days stipulated by law „Indication list of the Slovak Republic". Other clients have the right to choose from the offer of treatment stays.
2. Other – wellness and holiday stay have length in accordance with the wish of client.
3. The arrival day is the first stay day. Departure day is the day after the last day related to overnight.
4. Arrival: until 12:00 A.M. Departure: until 10:00 A.M.
Art. 6 Transfers
Spa offers transfer from airport or from the other places in Slovakia and surrounding countries and back. The prices of the transfers are not included in the prices of stays, spa provide them to client on demand including ordering of the service.
Art. 7 Rights and obligation of the client
1. Client´s rights:
- To receive services in agreed extent and for information about price, content or program of the stay.
- To cancel ordered services – withdraw from contract with acceptation of the cancellation conditions,
- To inform in written about change of service user together other prerequisites containing order of stay.
2. Client´s obligations:
- Behave in such a way that would not restrict or endanger progress and realization of stay and other stay´s participants. Otherwise bears fully responsibility for the consequences.
- Adhere to stipulated stay program
- Adhere to provisions of spa order, warnings and recommendation displayed in spa premises, to observe notifications about deposit of jewellery, money and other valuables
- To observe instructions and recommendations of spa sent with order confirmation
- To observe information materials that are stipulating conditions of stay in spa
- To cooperate with spa to ensure necessary changes, claims or insurance events
- Clients before spa treatment or procedures purchase has to evaluate upon arrival their health condition, contraindications and they are also obliged to attend medical examination or minimally fill out health questionnaire.
- In case of cancellation of the ordered stay or procedures client has to inform spa about this fact and has to accept cancellation fees.
- Legal persons are obliged to provide GBT to stay participants and ensure participants' observe of them.
- Clients have to identify (with ID´s, cards, wristbands like that, obtained upon arrival in reception) in all premises of Spa and Spa & Aquapark. ID things are not transferable and there is not possible to change data in them. Upon departure is client obliged to return or identification items in reception. In case of proven abuse is client obliged to pay fine 100€.
- To identify upon departure to stay (more than one night) to the reception with valid ID (identification card, passport) due to registration of guests.
- Foreign nationals are obliged to submit in spa further documents about their residence in the Slovak Republic according to valid laws / Law No. 404/2011 Coll. about the residence of foreign nationals in valid wording/
Art. 8. Rights and Obligations of the Spa Facility
1. Spa has the right before concluding the contract on stay or before sale of free procedures to provide proper information about all facts that can influence client´s decision to buy stay or free sale procedures-. In case of circumstances that prevent to provide service the client under agreed conditions spa reserves the right to change program, price of stay, change dates of arrival and departure, change accommodation or cancel the stay. In case of change spa have to notify ordering party at least 3 days prior arrival or start of ordered procedures.
2. Spa has the right to withdraw from the contract or end client´s stay untimely or withdraw from procedure providing if client despite the warning and notification breaches proprieties, inadequately intimidates or endangers other clients, spa employees, or intimidate or threaten other client of the spa, employees, their safety, health and property or if violates his/her obligations in the other way.
3. SLK TT as a service provider has the right to:
- exclusively and unilaterally change these GTCs
- carry out changes in the assortment, scope and content of products and provided services and the conditions of their provision
- carry out changes in the price list (for products and services) and changes in the conditions of the provision of products and services under conditions set in these GTCs
- charge cancellation fees in the amount and under conditions set in these GTCs
Art. 9 Discounts on stays
In case that client is entitled for discount client has to claim for it upon the order of the stay. If client does not do so discount will not be acknowledged. Discounts cannot be jointed, counted up or combined, the discounts are not applicable for last minute stays, bargain stays and "tailored „stays. Clients can apply for highest from discounts that are entitled for.
Art. 10 Cancellation terms
1. The ordered stays and procedures are possible to cancel in writing only with the notice addressed to the spa. Number of days determining cancellation fee is counted from day of delivery of the cancellation notice.
2. Cancellation fee is as follows:
- 20 – 15 days prior the planned arrival: 10 % of stay price or price of ordered procedures
- 14 - 7 days prior the planned arrival: 30 % stay price or price of ordered procedures
- 6 - 3 days prior the planned arrival: 50% of stay price or price of ordered procedures
- 2 - 0 days prior the planned arrival: 75 % of stay price or price of ordered procedures
3. No financial reimbursement is provided for unused reserved services and changes to reserved services during the client´s stay (accommodation, board, spa treatments).
4. In case of client´s early departure (ending of stay) there is no financial reimbursement for board, accommodation, treatment, neither procedures nor any other reimbursement for further ordered services. In case of early departure (in comparison with order) client could be charged with cancellation fee amount of 50% for unused ordered services.
5. There is not charged any fee for change of the person of the client performed properly and on time.
6. If is spa from certain reason to reimburse any adequate part of paid services it will be done within 30 days from arising the title. The cancellation fee or also flat administrative amount 10€ will be deducted from this title. The client bears the transaction costs related to such reimbursement.
Art. 11 Prices
1. The price lists are published in digital form in the website of spa, on demand they can be provided also in printed version.
2. All prices are mentioned according to:
- Type of stay
- Season
- Spa hotel /hotel/
- Category of the room /single room, twin bedded room, apartment/
- Kind of procedures in a free sale
3. If stay of the client comes under two or more seasons the total price for stay will be accounted in accordance with the number of night in particular season. Spa has the right to change the Schedule of the seasons.
4. Spa has right to change prices and contents of the packages.
Art. 12. Refusal to Provide Services
SLK TT has the right to refuse to provide services in the case of contraindications for spa treatment.
Art. 13. Discount Coupons
1. SLK TT as a service provider may issue in specific cases Discount Coupons with various nominal values or discount values which can be applied by its clients when using provided services. Through a Discount Coupon a client may apply a discount on provided services up to the amount indicated on the Discount Coupon.
2. The Discount Coupons apply to all types of stays realised by paying clients within the periods indicated on the Discount Coupons. The Coupon can be applied only once for any type of stay for paying clients, in the medical facility indicated on the coupon and for stays realised within periods indicated on the Discount Coupon. Discount Coupons can only be applied for stays paid for as a whole unless explicitly stated otherwise on the Discount Coupon.
3. Clients are requested to present the code of the coupon on reservation of a stay and reserve the stay in advance on the phone number indicated on the coupon, 1 month before expiry of the coupon at the latest. Validity of the coupon is defined as a date or time period and indicated on the Discount Coupon. Clients are required to present the coupon on the payment for their stay.
4. Discounts and coupons cannot be cumulated. Coupons cannot be exchanged for cash, are not refundable and cannot be replaced. SLK TT has an exclusive right to determine a time period for the application of the coupon. If information stated on the coupon differs from that stated in GTCs, information indicated on the coupon shall prevail.
Art. 14. Force Majeure
1. Neither Contracting Party shall be in default in respect of any obligation if this breach was due to a Force Majeure Event, i.e. any act beyond the control of the parties which was unforeseen and irreversible (natural disaster, strike, war, earthquake and so forth) and which excludes responsibility of either party as stipulated by applicable legal regulations, unless the breaching party could avoid effects of such circumstances. Force Majeure Events do not involve circumstances of subjective character or those which appeared as a result of personal and economic conditions of either Contracting Party.
Art. 15 Complaints, liability
1. In case that service´s quality or extent id lower than agreed in contract, client has right to claim. Client can claim for wrongly provided service without unnecessary deferral, directly at the place for provided service from responsible worker.
2. The subject of the claim is not such damages and physical harms that are exempt from insurance coverage. In case of such circumstances which arising, progress and consequences are not depending on activity and procedure of spa or in case of such circumstances when client does not fully or partially use ordered, paid and from the side of spa provided services, client does not have right for reimbursement or discount from the price of such services. Spa is not responsible for damage that did not cause spa or spas subcontractor and damage was caused by third party that is not related with stay and service providing or such damage is caused by circumstances that cannot be stopped event with the enormous effort or as a consequence of unusual and unpredictable circumstances.
These General Terms and Conditions become effective and come into force on 6 October 2012.
